ATG Entertainment Privacy Policy

This Privacy Policy describes the policies of ATG Entertainment US Holdings, Inc, Jujamcyn Theaters LLC, IEHL US Holdings, Inc. and their majority owned subsidiaries (collectively, “ATG,” “we,” “our,” and/or “us”). 

We value the privacy of individuals who use our websites and related services (collectively, our “Services”). This privacy policy (the “Privacy Policy”) explains how we collect, use, and share Personal Data from users of our Services (“Users”). For the purposes of this Privacy Policy “Personal Data” means any information that can be used to individually identify a person, such as your name, residential address, city, state, and zip code, date of birth, and e-mail address, as well as information that is reasonably capable of being associated with or could reasonably be linked to you or your device.

By using our Services, you agree to the collection, use, disclosure, and procedures this Privacy Policy describes. This Privacy Policy also covers our treatment of any Personal Data that our service providers, contractors, and other third parties share with us. Beyond the Privacy Policy, your use of our Services is also subject to our Terms of Use. This Privacy Policy does not apply to the practices of entities that we do not control (including, without limitation Third Party Platforms), and their sites, services or applications, or to individuals who we do not employ or manage. While we attempt to provide access only to those third parties that share our respect for your privacy, we cannot take responsibility for the content, actions or privacy policies of those third parties. We encourage you to carefully review the privacy policies of any third parties you access.

Our Services are provided in the United States. By using our Services, you consent to the transmission of your Personal Data to and in the United States. 

If you are a resident of the European Union, United Kingdom, Lichtenstein, Norway, or Iceland, you may have additional rights under European Union Regulation (EU) No. 2016/679 of 27 April 2016, also known as the General Data Protection Regulation or GDPR and comparable laws in such countries (the “GDPR”) with respect to your Personal Data, as outlined below. We are the controller of your Personal Data processed in connection with any website or service that we directly control, manage or operate for purposes of the GDPR.

Information We Collect

We may collect a variety of Personal Data from or about you or your devices from various sources, as described below.

A. Information You Provide to Us.

Your Personal Data. If you sign up for an account, we may ask you for your name, email address, phone number, and postal address. If you sign up for notifications or updates, or participate in our contests, sweepstakes, or surveys, we may ask you for, amongst other details, your name, title, email address, mailing address, phone numbers, date of birth, demographic information (e.g., gender, age, income level, etc.), contact preferences, and other information. If you purchase a ticket or conduct any other transaction at one our venue box offices, we may ask you for, amongst other details, your name, email address, phone number, and postal address.

Communications. If you contact us directly, we may receive additional information about you. For example, when you contact us for customer support, we may receive your name, email address, phone number, the contents of a message or attachments that you may send to us, and other information you choose to provide. If you subscribe to one of our newsletters, then we may collect certain information from you, such as your name, email address, mailing address, phone numbers, and other information. When we send you emails, we may track whether you open them to learn how to deliver a better customer experience and improve our Services.

Careers. If you decide that you wish to apply for a job with us, you may submit your contact information and your resume online. We will collect the Personal Data you choose to provide on your resume, such as your education and employment experience. You may also apply through third parties. If you do so, we will collect the Personal Data you make available to us via any third-party platforms.

Payment Information. If you make a purchase through our Services, your payment-related information, such as credit card or other financial information, is collected by our third-party payment processor on our behalf. 

B. Information We Collect When You Use Our Services

Location Information. When you use our Services, if you allow us, we receive your precise location information. We may also collect the precise location of your device when our Services are running in the foreground or background. We infer your general location information, for example by using your internet protocol (“IP”) address.

Device Information. We may receive information about the device and software you use to access our Services, including IP address, registered domain or home server, browser type, operating system version, phone carrier and manufacturer, application installations, device identifiers, mobile advertising identifiers, and push notification tokens.

Usage Information. To help us understand how you use our Services and to help us improve them, we automatically receive information about your interactions with our Services, like the pages you visit, pages and content you request when you click on the links on our Services, number of clicks, referring website’s address, the searches you conduct, purchases you make including event tickets, any content you post, and the dates and times of page requests.

Information from Cookies and Similar Technologies. We and our third-party partners collect information using cookies, pixel tags, or similar technologies. Our third-party partners, such as analytics and advertising partners, may use these technologies to collect information about your online activities over time and across different services. Cookies are small text files containing a string of alphanumeric characters. We may use both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to our Services.

C. Information We Receive from Third Parties.

Partners. We may receive additional information about you, such as demographic data, from third parties such as data or marketing partners and combine it with other information we have about you.

Third-Party Services. You may also post photos, comments, or reviews on our pages available through third-party platforms, including Facebook, Twitter, and Instagram. If you do so, we and others may be able to view information that you make available through these third-party platforms.

Third-Party Platforms. When you purchase a ticket or interact with an e-commerce platform with which we have a business relationship we may receive and hold Personal Data about you from that entity to the extent it has been provided by you to that entity. We will also receive the number of tickets you purchased, the performance for which you purchased, the price you paid for your tickets, your seat locations, and your method of payment, including the type of credit card you used (which may also include partial and limited credit card information (e.g., last 4 numbers only and expiration date).

How We Use the Information We Collect

We will process your Personal Data only if we have a lawful basis for doing so. Lawful bases for processing include contractual necessity, our legitimate interests or the legitimate interest of others, and consent.

  • Contractual Necessity:  We use your information when you enter a contract or transaction with us (for example to buy a ticket or a service within our venues) so we can process your order, send you customer service emails including booking confirmations, event reminders, take payment and to provide you with customer support. 
  • Legitimate Interest: We process Personal Data when we believe it furthers a legitimate interest of ours or a legitimate interest of a third party. These instances include:
    • Marketing. To contact you with information or offers regarding upcoming events, products or services offered by us, our affiliates, or ticketing platform, any of the attractions in our venues, or other third parties This may be via email, push and web notifications, SMS, or social media platforms.
    • Analytics. In order to operate, improve, understand and personalize our services, business operations, and communications. We may process Personal Data to conduct data analysis, track usage statistics, audits, research, marketing analysis and product development.
    • Advertising & cookies. Where local laws permit, to analyze and track data to deliver tailored advertising and marketing communications on our websites. See our Cookie Policy  for more information.
    • Partners. We sometimes work with certain partners who we share data with. These are third party data controllers that we work with to provide certain additional services.
    • Security. To detect, protect against or deter fraudulent, illegal or harmful actions. Internally we may process personal data to diagnose problems with our servers and administer our websites.
    • Compliance. To comply with legal, contractual obligations or to complete corporate or financing transactions.
    • Consent. In some cases, we process Personal Data based on the consent you expressly grant to us.  When we process Personal Data based on your consent, we will expressly indicate such basis to you at the point and time of collection.

How We Disclose the Information We Collect

We may disclose the categories of information described above in “Information We Collect” to the entities and for the purposes described below.

Affiliates. We may disclose any information we receive to our affiliates for any of the purposes described in this Privacy Policy.

Vendors and Service Providers. We may disclose any information we receive to vendors and service providers retained in connection with the provision of our Services.

Analytics Partners. We use certain analytics services such as Google Analytics to collect and process certain analytics data. These services may also collect information about your use of other websites, apps, and online resources. Advertising Partners. We work with third-party advertising partners to show you ads that we think may interest you. Some of our advertising partners are members of the Network Advertising Initiative (https://optout.networkadvertising.org) or the Digital Advertising Alliance (https://optout.aboutads.info). If you do not wish to receive personalized ads, please visit their opt-out pages to learn about how you may opt out of receiving web-based personalized ads from member companies. You can access any settings offered by your mobile operating system to limit ad tracking, or you can install the AppChoices mobile app to learn more about how you may opt out of personalized ads in mobile apps. We may also share Pixel Data with the producers of shows to which such Pixel Data relates or to those producers’ marketing consultants.

Event Partners. When you make a purchase through our Services for an event, we may disclose certain information about you (such as your name and contact information) with the event partners we work with to put on the event, such as the event promoter, presenter, venue, or artist. We disclose certain information about you with our event partners so that they can run the event and for other reasons described in their privacy policies.

As Required By Law and Similar Disclosures. We may access, preserve, and disclose your information if we believe doing so is required or appropriate to: (a) comply with law enforcement requests and legal process, such as a court order or subpoena; (b) respond to your requests; or (c) protect your, our, or others’ rights, property, or safety. For the avoidance of doubt, the disclosure of your information may occur if you post any objectionable content on or through our Services.

Merger, Sale, or Other Asset Transfers. We may transfer your information to service providers, advisors, potential transactional partners, or other third parties in connection with the consideration, negotiation, or completion of a corporate transaction in which we are acquired by or merged with another company or we sell, liquidate, or transfer all or a portion of our assets. The use of your information following any of these events will be governed by the provisions of this Privacy Policy in effect at the time the applicable information was collected.

Consent. We may also disclose your information with your permission.

Your Choices

Marketing Communications. You can unsubscribe from our promotional emails via the link provided in the emails. Even if you opt out of receiving promotional messages from us, you will continue to receive administrative messages from us.

Do Not Track. There is no accepted standard on how to respond to Do Not Track signals. Therefore, except as required by applicable law, we do not respond to such signals.

Your Options and Legal Rights

Where you have given us your consent, you can withdraw it by doing the following:

  • To stop receiving our marketing you can change your preferences within your ATG account, follow the unsubscribe instructions in any of the emails we send you or contact us and we will do it for you.
  • To opt out of the use of cookies and tracking tools, please see our Cookie Policy. This can also be done my updating your preferences in the cookie management tool on our website. 
  • To opt out of location tracking and push notifications, you can change the settings on your device or keep your location off. To stop web push notifications, you will need to use your browser settings. 

Where we have relied on a legitimate interest (applicable to our markets that rely on consent), you can object to it by doing the following:

  • To object to receiving our marketing you can change your preferences within your ATG account, follow the unsubscribe instructions in any of the emails we send you or contact us and we will do it for you. 
  • To object to personalization you can change your preferences within your ATG account. If this option is not available, you can contact us and we will do it for you.

If you are a resident of California, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana or another state with similar comprehensive consumer privacy law (collectively, “Covered States”), you may have specific rights regarding your personal information (sometimes called personal data) under: the California Consumer Privacy Act (“CCPA”), Virginia Consumer Data Protection Act, Colorado Privacy Act, Connecticut Data Privacy Act, Utah Consumer Privacy Act, Texas Data Privacy and Security Act, Oregon Consumer Privacy Act, Montana Consumer Data Privacy Act and other applicable laws (collectively, "State Privacy Laws").   • Opt-Out of Sale/Profiling/Targeted Advertising. You have the right to opt out of the sale of your personal information. This will also opt you out of targeted advertising or profiling.
  • Non-Discrimination. We shall not discriminate against you based on your exercise of any of the above rights.

Data Retention

We retain your information for as long as necessary to provide you Services, to obtain payment on your transactions with us and to maintain a record of your transactions with us for financial reporting and compliance purposes. We keep your order history on file so that we can provide you with information on what you ordered previously, unless you ask us to delete it.

Children’s Privacy

In line with The Children's Online Privacy Protection Act (“COPPA”) we do not knowingly collect or solicit Personal Data or other data from anyone 16 years of age or younger, except if we are legally required to collect such information, and except in the case of some promotional activities that we sponsor (such as a sweepstakes or giveaway) that may be open to individuals who are 14 and over, in which case, we require that individuals who are at least 14 years old but less than 18 years old obtain parental or legal guardian consent before participating in any such promotional activity and require such parent or legal guardian to consent to the acceptance of any prize by such individual in connection with such promotional activity should such individual be selected a winner. 

Additionally, we use Personal Data and other data collected from an individual who we know is 16 years of age or younger only in connection with the administration of a particular promotional activity open to such individual (in which event such information is deleted upon the completion of such promotional activity), or in connection with customer service, fraud prevention, security purposes or compliance with laws or regulations.  Any Personal Data or other data that we may receive from or in respect of an individual who we know is 16 years of age or younger, other than in connection with certain promotional activities as described above, in connection with any Ticket Transaction Data, or in connection with any legally required collection, will be deleted as promptly as possible from our system.

If you are 16 years of age or younger, please do not attempt to use any of our Services or the Site or send any Personal Data or other data about yourself to us unless you are participating in a promotional activity for which you meet eligibility requirements.  If you believe that a child 16 years of age or younger may have provided us Personal Data or other data, please contact us at [email protected].

International Visitors

Our Services are hosted in the United States and intended for visitors located within the United States. If you choose to use our Services from the European Union or other regions of the world with laws governing data collection and use that may differ from U.S. law, then please note that you are transferring your personal information outside of those regions to the United States for storage and processing. Also, we may transfer your data from the U.S. to other countries or regions in connection with storage and processing of data, fulfilling your requests, and operating our Services. By providing any information, including personal information, on or to our Services, you consent to such transfer, storage, and processing.

Changes to this Privacy Policy

We will post any adjustments to the Privacy Policy on this page, and the revised version will be effective when it is posted. If we materially change the ways in which we use or share personal information previously collected from you through our Services, we will notify you through our Services, by email, or other communication.
